Welcome to HelloMond (the "App")!

These Terms and Conditions ("Terms") govern your access to and use of the HelloMond app, provided by Younmin Bae ("we," "us," or "our").

By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By downloading, installing, accessing, or using HelloMond, you confirm that you have read, understood, and agree to be bound by these Terms.

2. Your Use of the App

a. Eligibility:

HelloMond is a general audience app. You must be at least 13 years old to use the App. If you are under 13, you may only use the App with the involvement and consent of a parent or legal guardian.

b. Permitted Use:

You are granted a limited, non-exclusive, non-transferable, revocable license to use HelloMond for your personal, non-commercial note-taking purposes.

a. Account Creation:

To use HelloMond, you will need to register an account. You agree to provide accurate, current, and complete information, including your email address, during the registration process.

b. Account Security:

You are responsible for maintaining the confidentiality of your account password and are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

c. Termination:

We reserve the right to suspend or terminate your account at our sole discretion if you violate these Terms or for any other reason, including but not limited to, periods of inactivity.

4. User-Generated Content (UGC)

a. Responsibility:

You are solely responsible for any notes (text or handwritten), images, or other content you create, upload, or store within the App ("Your Content").

b. Rights Granted:

By creating or uploading Your Content, you grant us a limited, non-exclusive, royalty-free license to host, store, display, and process Your Content solely for the purpose of providing the App's functionality to you (e.g., storing your notes so you can access them). Your Content is not shared publicly through the App.

c. No Infringement:

You represent and warrant that Your Content does not infringe any third-party rights, including intellectual property, privacy, or publicity rights.

5. Intellectual Property

The App, its original content, features, and functionality are and will remain the exclusive property of Younmin Bae and its licensors. HelloMond is protected by copyright, trademark, and other laws of the United States of America and foreign countries.

6. Payments and Subscriptions

a. Free and Paid Tiers:

HelloMond offers both free and paid tiers with different features and limitations. All prices for paid tiers, subscriptions, or one-time payments are as displayed within the App. We reserve the right to change pricing at any time.

b. Payment Processing:

Payments are processed through third-party services (e.g., Stripe). Your use of these payment services is subject to their own terms and conditions.

c. Refunds:

Refunds are handled on a case-by-case basis. To request a refund, please contact us directly at younmin123@gmail.com.

7. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the App's accuracy, reliability, or availability. We do not warrant that the App will meet your specific requirements, be uninterrupted, timely, secure, or error-free.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Younmin Bae, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

9. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will immediately cease.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions.

12. Privacy Policy
